Emo township returning to court over Human Right Tribunal case
Another court hearing has been set related to the Human Rights Tribunal Decision regarding the township of Emo and Mayor Harold McQuaker.
The case is returning to a Divisional Court in November.
Lawyers for the township and mayor want a judicial review of the Tribunal’s ruling that declared the township discriminated against Borderland Pride by rejecting a Pride declaration in 2020.
The court heard the matter earlier this year, but indicated the township had not first sought a request for reconsideration from the Tribunal.
The Tribunal normally requires such requests to be made within 30 days from the release of its decision.
The court had requested the Tribunal to take the delay into account.
However, the Tribunal rejected this summer, stating that even “if the request had been made in a timely manner, the grounds for seeking reconsideration do not meet the reconsideration criteria.”
The case now goes back to the Divisional Court with a hearing date set for November 30th.
